DUI EVALUATION
In Illinois, in order for someone to be eligible to receive court supervision after either a plea of guilty or a finding of guilty following a trial, the law requires that the driver be evaluated by a professional licensed by the State of Illinois.
This is a very important part of the DUI process. Court supervision allows individuals to regain their driving privileges after a Statutory Summary Suspension is completed. Without a drug and alcohol evaluation a judge must enter a conviction for the DUI, which results in a mandatory license revocation.
This requirement of an evaluation applies to anyone requesting a Judicial Driving Permit as well. This is a court order which allows a person to drive for educational, medical or job related purposes, during the term of a Statutory Summary Suspension, under certain circumstances. A judge cannot issue such an order unless there has been a professional alcohol and drug evaluation.
